you can remove the pic from the auction, even if it has started. i would make him take it off, especially for selling a rip-off item. it takes two seconds, ive even done it to my own auctions before.

OK now this is getting fun:

Tracey Murphy:
where is the copyright on the picture???????????.....

me:
If you read the copyright laws provided in the links you would know
that pictures do not need to be copyrighted on the picture.

Ebay has already be contacted and I am sure they will contact you soon.

Thank you.

Tracey Murphy:
that is fine.....i have done nothing wrong.......but you have a nice day im going to go out on friday night and enjoy myself not sit here on the computer and argue about bull˟˟˟˟.....anyways you have fun with your oversized pile in the driveway......and i wouldnt bother spending all your time and money contacting your lawyer....you will probably need to replace the tranny and rear end in the piece with the money instead.......PEACE!

me:
Actually yes, you have done something wrong, you have broken the law.
And until you take the pictures down you are still breaking the law.
So you can provide me with your full name, address, and contact number
so that my attorney can contact you. BTW, you are also comitting
fraud as my vehicle does not have your product installed in it.
Endorsements cost money. You are just a plain thief. Your reputation
has already spread far and wide on the auto forums for stealing images
of Isuzu's, Toyota pickups and other numerous makes and models, none
of which ever used your product or gave permission to use their
images.

And you can call my vehicle whatever you want, you obviously dont have
anything of your own to take a picture of, so you have to steal other
people's.

Good Luck!

sherri_girl;

You may also want to point out to him that we're working hard to get the word is out on his mod - and the claims he's making are hinging on deceitful business practices, not to mention price gouging.

The resistor he's selling comes in packs of 5 at Radio Shack for $1 (I think that's still the price) or in bulk for a LOT LOT LOT less. Even at RS prices, he's making almost 1400% profit - PLUS he's gouging on shipping (this thing weighs less than a gram).

There's nothing "illegal" about selling something at this kind of a profit margin, but it certainly works towards defining his character.

In regards to getting a response from eBay... I've dealt with eBay before on fraud cases. They are VERY slow to respond - it took about 2 1/2 days to handle the last one, and that was on something that people were bidding on for above $3500. In the end, I proved the issue and "won", the auction and the seller were whacked - but it took a while.

Something else...

Some of the pics I have online have digital watermarks in them. This is a concept where you can encode information in a picture in such a way that it will withstand being resized, color shifted, and in some cases even re-shot. The best part is that it happens in such a way that it does NOT degrade from the quality of the picture. The watermark is invisible to the viewer.

In this eBay example, you would be able to bring up a (free) reader, point it to the image from the auction, and it would show that the image belongs to you.

I use software from a company called Digimarc. Pretty cool stuff...

Thank you guys for all the help. Obviously, I have no experience in this area, this is the first time this has ever happened to me...well that I know of anyways.

My friends are having a ball emailing him stuff and he says that if I was a decent person I'd just let him use them - what a moron. He's also saying that since I'm being a **** about it, he's just going to continue using the pictures cause he's not doing anything wrong. So im just taking a stroll through cardomain and leaving a nice little note on every page that has a car that he's stolen pics of and letting them know their car is on Ebay. You'd be surprised how many I found already.

Like I said how sad, even if he is forced to remove the pics, he'll just steal someone else's.

He's obviously ignorant and knows he's in the wrong as he is resorting to vulgar language - Im just waiting for a threat that I can report to MA police.

Before this incident I had no idea things like this go on. The sad part is, if he had just asked permission, I'd prolly let him use it as long as it stated that the image was just there for looks and my vehicle did not have the product installed.

Yeah I just now checked, it doesnt. I've e-mailed the thief like 3 times on my e-bay account saying we Members of the Toyota family dont like it when people steal our stuff. Just finally glad to see it off the listings. Sorry you had to go through that.
