I used to sell Mercedes Benz, it was not unusual to see the new models go for 5-10k over sticker. Someone would get pre-qualified for financing, put a deposit down then do what this guy is doing. He will probably get 2-4k over MSRP.

I'm thinking technically and legally, regardless of how he has it worded in the auction, the buyer is only responsible for paying the purchase price of the auction. The only terms that are legally binding are within the bid. It would be great if this backfires on him and he has to give it up for a couple of grand. Hehehe...I may go bid just for the hell of it and force him into a legal battle. Oooooo, if I only had a little more free time on my hands...
