I don't know how big of a seat you need but If you could find a rear bench from a Samurai, I think it would fit quite nicely. As far as legality goes, i've seen people slap seats and seatbelts in the back of there pickup trucks and have no problems whatsoever with the Police dept. as long as there is seatbelts for all occupants. Of course laws vary depending on location.

im going to look for a seat that is no biger than 39", because i have 40" between wheel wells
and im no doubt going to put seat belts back there
has the law changed about lap belts?
or do i even have to wory about that because its an 85

I'm not sure on the seatbelts, I believe as long as your vehicle was manufactured with that type of equipment then it should be fine (not sure about aftermarket mods such as the seat). A samurai seat should fit right inbetween your wheel wells. I had one I was going to put in the back of a Nissan pickup I owned in high school, and it fit inbetween the wheel wells.

It took me quite a while to sell the third row seat out of a 96 that I bought... it was low, only about 4 inches off the floor, and two sets of lap belts were connected to the seat frame.... It attached to a couple of heavy metal brackets, mounted to the floor with large bolts. With the pull of two pins, the whole thing would come out, very handy. They sell for about $800 though .... sold mine for $200.

One time I saw a 89 4runner that came with a set of factory jump seats. They evidently had this as a factory option back then. It sat two people rather uncomfortably, with it being slightly shorter across than the factory back seat. Maybe you might be lucky enough to find some of these.
I haven't been able to find any option on a 4runner regarding this prior to '04.

You could always put the 3rd row back to back, and try to find some seat belts that would bolt to the 4runner roll bar. I have seen some 1st gens with factory shoulder belts that bolted to the roll bar, and have a friend who mounted some shoulder belts from another vehicle for his factory back seat.
You could essentially do the same thing in reverse for the 3rd row.
I just got another idea for mounting the seats, use the places that the roll bar bolts in the bed to mount your custom seat bracket. install the custom bracket first, and bolt the roll bar over it. (if that makes sense)

The driver and passenger front seats count as the first row. And additional row of seating in the cargo area counts as the third row. You can see an example of a third row in the link to my thread in one of the posts above.
