Thumbs down 85excab

Recently 85excab listed a "v6 4.56 3rd with a true track" for sale in the classifieds. https://www.yotatech.com/forums/f11/...d-3rds-232720/. I asked if the Detroit True Trac was in good working order and was told it was in great working order.

Once this was confirmed, I jumped on it immediately, it being exactly what I wanted. After I received the 3rd member I began researching what I needed to do for the install. While I was at Zuk's website (gearinstalls.com) I noticed that my Detroit True Trac did not look like the other ones he had installed. Upon further inspection I noticed that I had a "lunch box locker" installed.

I contacted 85excab, informing him of the situation, and got the response "i sold this to u as a locker and not a lsd, sorry i called it a trrue track instead of a lock rite, but i cant afford to eat $100 in shipping. there were quite a few others interested in it if u want to sell it on here and get your money back.its a detroit lunch box locker, i never said it had a lsd"

I informed him that I only bought this because it was listed as a True Trac and I did not want a "lunch box locker." I also stated that the other people interested in it would be expecting what was listed for sale (True Trac) and not what they received.

I offered to ship it back to him (at my expense) if he would refund my money. I have sent him a couple of pm's with no response.

Now he seems to be ignoring me and has changed his public profile so that I can not see if he has been on Yotatech and seen my pm's.

I am only asking for him to refund my money and I will ship the 3rd member back to him, at my expense.

I wonder what he would think if I did this to him.

-Hunter

No, I do not have it in an email, but I do have it in private messages. We did not communicate through email.

I am just trying to return it to him and get my money back, but am getting not any response.

Hold on to the PM's and let's see if he replies to this thread, or to you via PM in the next few days.

Needless to say, the Staff is aware of the problem so we'll be looking to see if he replies.

Thanks,

Fink

I think you are screwed, as I wrote him this morning and told him he needs to do the right thing as ripping off members is ban worthy.
He wrote back and said to ban him.

No one should do business with this rip off artist.

PS, since he answered me, I am sure he read yours.
I wonder if he is on Pirate, as they hunt down those who rip off others.

I don't know what to do. Last night I opened a dispute against him through PayPal. I guess I will see how that goes.

I never thought something like this would happen on here. I have been on here a long time and I guess I thought that I would not get ripped off by someone on here (that has sold several things in the past). I figured once I let him know it was not what I was expecting, he would let me send it back to him. I was way wrong.

Thanks to everyone that has looked in this situation. I really appreciate it.

PayPal usually makes the right choice.
Document your claim as much as possible.
I had to go after a deadbeat customer last month myself.

Good luck.

Please post the outcome.

Thanks to whoever closed his thread! I was afraid he would edit it and take True Trac out of the listing.

Brian closed it. :wabbit2:

If PayPal needs something from a Staff member verifying what the initial thread says - I'd be happy to contact them for you.

Thank you.

Right now I am waiting for him to respond to PayPal.
I am not sure if he will or not because he knows he is at fault.

In my experience, if the seller in question does not reply, PayPal will side with you due to lack of evidence on his behalf.

Either way - I hope it works out.

Either way, his permissions to post new classifieds ads has been removed.
I have not banned him yet as I was waiting to see if he would man up and post a reply to this thread.
I guess not...

I am pretty sure I won't hear from him again. I have sent multiple pm's trying to work it out with no response.
