WOW, Im sorry man, I couldnt imagine if someone hit my Yota I would be devastated.Couldnt you just use your insurance money, to fix it? unless theres more damage than it totaled out to be.

Sue the drunk! Do not let them off, claim he was totally at fault for the accident.
I got sued and my insurance company had to settle despite it being stolen by a punk, who admitted stealing it.
I think you find the insurance company very interested in settling this quickly. So do not be afraid to ask to be "made whole" for your losses.
