Clutch cylinder, master or slave failed?
Seat or socket broken and jammed in shifter?
Check hydraulics first and go from there, if it won't shift the clutch probably isn't moving

I assume that he can't shift out of 3rd even with engine off. If that's the case, it isn't likely to be a hydraulics issue (a weak hydraulic cylinder or a fatigue crack in the clutch pedal will keep the clutch from opening all the way, and the drag on the clutch with the engine running keeps you from shifting).
Sounds more like a broken socket in the shifter. I don't know enough about the manual to know if you can get a good look into the transmission without removing the transmission altogether.

Even with the car off it still stays in 3rd it's not in the actual 3rd slot the shifter stays where the neutral would be but it feels like 3rd gear so I'm guessing really

You cash try to take the shift boot off and unbolt the housing and see if the socket is in tact. Marlin crawler has a video on how to install one on their website

When I install a used transmission and don't want to put it all together until I see that it shifts, I use one of my ratchets and stick it in the hole for the shifter. At least that way you can see if it is the shifter that is keeping it from moving.
With my ratchet in the transmission, basically everything is backwards. Reverse is top and left and 1st is bottom and right, if I am recalling everything correctly.
If you cant get it out of gear that way, I feel you have some issues in the transmission that is going to be a much bigger problem.
