counter at $5500 and you keep it and they'll bite - that's a "value" of $6000+ for it, and i think that's very fair to you.

hold out on any medical/lost-time stuff (don't even discuss it with them) until after the property damage is settled and they'll be MUCH more likely to give on value. if they bring it up, you can mention loosing time at work, pain/soreness, etc, but don't talk details. just tell them that the biggest problem you have is getting to/from work and looking for a new vehicle. tell them you want to get that taken care of then you'll be more willing to talk about the other stuff. that will get them to bite even faster on settling the property damage claim.

after they agree to the property damage settlement and put it in writing, then submit a claim for lost wages, etc and see where that goes. even if you had to take vacation, etc to get paid, you still get reimbursed from them due to the "lost time" involved.

lol... done it before and made some mistakes along the way, so now you're learning from my mistakes. also, my dad has been an independent insurance agent for 30+ years with various companies, so i've picked up a thing or two from him on how to deal w/ the claims adjusters to get his clients the best settlement for them - NOT the insurance company's bottom line. he care's about the people he deals with so he passing along info like this to them. they reward that with continued business with him and tons of referrals. so much so that he hasn't spent a dime on any advertising for the last 25 years other than a tiny yellow-pages ad every year.

Not true from my experiences, at all. Unfortunately, I've had the pleasure three different times. Attorneys do this kind of work on "contingency" for the most part -- meaning they work on your behalf for a cut of the final settlement. No money up front. If you get screwed, so do they.

Twice I've had to lawyer-up against the others drivers insurance co. Once against my own. Each time I started getting multiple calls a day wanting to know what it would take to get it settled "now." In all cases, I informed the insurance company that they'd had their shot at negotiating with me, and they needed to talk with my attorney. Each time I got at least triple what the adjuster had been offering me when our negotiations broke off.

It sounds like this is starting to work out favorably for David. Good to hear. But I wouldn't hesitate to hire an attorney if they start dragging their feet and offering peanuts as a settlement.

My bud went to look at the 4runner and the dealer has it marked at $6995 on his lot.

Took it to a mechanic who said tranny is going !!!

He did not buy it obviously

Well I have to laugh....

I must have broken the first Insurance adjuster as I just got told 'the file has been passed' and a new adjuster will be calling me.

Not sure if this is progress but its different
