Everyone knows exactly what to do when they are not the one in the situation. Buddy shouldve used his head and timed a pass acordingly.
Make him pay to fix your truck, or go through the insurance if he wont. I doubt you would be deemed at fault... unsafe passing.

did the cop get a report?? call your insurance asap.. call the guy the hit you and get estimates... dont procrastinate.. he must fix your truck he was passing you . its his fault

So to the cops: a friend tries to pass the other and the second party 'grabs 3rd and hammer down,' not something that a concerned, safety oriented motorist would do but something a competitive situation would produce.
How can you honestly say that "I sped up when I saw my friend trying to pass me, and the oncoming traffic approaching, because I wanted my friend to have room to get in front of me..."?
and yielding the right-of-way to avoid an accident is a law in most states.

Who cares how it happened, its over now. My advice would be to get a hold of your insurance agent, and explain your situation. He/She will probably have a solution for you. I think i understand what you did, was because when you saw your friend, he was slightly behind you and he was already on the brakes, so you gunned it to try to allow him room to get back in your lane. Damn, it was a split decision, some don't respond as well as others, and you did what you felt was right at that split second.
And i agree with Jay on this one.

If he thought the guy was slowing down, him speeding up would give the guy room to get in behind him... I can't really say much more since I was not there and I don't know exactly how it went down.
Anyone with a brainstem wouldve layed on the brakes and got back behind the car they were trying to pass. Passer is at fault.
Who has the right of way? The passer or the car getting passed? Seems in my head the passer is the one at fault here, not the other guys fault he decided to pass in an unsafe manner.

thanks i used to race sprint cars with this kid i know how he opperates.
my original thought was to break and let him go in front of me, i noticed he was going/was breaking so i grabed a gear and tryed to give room but he locked it up. it was a hard choice. swerve left get hit head on. hold wheel tight and gas it. or swerve left of a straight drop off with no gaurd rail.
so sense we left the scene a police report cant be wrote up but a civil repost can. but after my parents and his talked we are going to leave the insurance out of it. im going to get a price quote in the am.

That sucks...but he wasn't technically doing 50mph worth of damage to your fender. He WAS going 50mph...but he didn't hit it with 50mph worth of force to your truck...make sense? Anyway, the damage isn't that bad. Either forget it or try to get your money back.

So you're going 50 and your friend is trying to overtake you, I'm assuming he is already well above 50. You see oncoming traffic, dump 3rd and punch it hoping to overtake your friend, who is already going faster than you, and give him room to get into the lane before causing an accident? As soon as you saw your buddy wasn't going to make it, and yes you should have realized this too, why wouldn't you brake hard and get the hell off the road, leaving room for your buddy to do what he needed to do. I agree your friend is at fault, but it seems like with some rational thinking you could have avoided the accident.

I agree with jay and 904 runner not the best judgement exercised by either one of you but if the guy wont take responsibility and pay for the damage go through the insurance and get it that way.
I had a "friend" in high school who backed right into my truck at a party. He tried to blame it on me but I wasnt moving, the truck wasnt even on, and he just backed right into me. Anyway he pulled the same irresponsible act that your "friend" is doing and wouldnt pay for the damage, which I gave him a deal on cause I was gonna do the work. So I went to his dad who I knew pretty well and told him what happened. I had the money the next day along with an apology.
Bottom line your pissed now but try to think rationally and do what you have to to get your vehicle fixed. Be calm about it and maybe he and you will learn a lesson in the process. Good luck

Gee he sounds like a "True Friend" to me, because if a cop would have seen you two driving like that you both would have been locked up and your idiot friend would've probably said, "Damn that was fun!"

You already established the chain of events in the original post: your friend (whom, stated later, you already know drives like jacka$$) tries to pass you, you see your friend can't pass, you grab 3rd and hammer down, then your friend brakes when HE realizes he can't make it because you sped up to block him. That's how it'd sound to a cop and in court. Not to mention you're also hauling a boat (either towed or in the bed).

2). I didnt speed up to prevent the pass.
3). I talked to the cops today they said im NOT at fault at ALL no matter wat.
4). If i wouldnt have sped up when i did the cop said we WOULD have flipped rolling down a steep a$$ cliff.
5). Dont chang up my post. example saying a sped up to block him. in reality i sped up to give him room. so untill you read threw it all and get your facts straight dont post back.
