So after reading all of this i have a question, if the shifter seat is bad will that make the transmission pop out of first gear ?, or could it be another problem ?.

I would not think so because my plastic seat broke apart and fell into the transmission years ago, and my transmission has never popped out of any gear.

On the other hand.

The metal ball on the end of the shift lever mates with the plastic seat so you do not have slop in the shift lever. If there is too much slop then you cannot engage the gear fully, and when a gear is not engaged fully it can pop out of gear when you step on the gas.

Might want to pull your shift lever to see what is going on.
