have i been scammed? !!!!

have i been scammed? !!!!

ok so i bought a 90 4runner the other day. i bought it at a used car dealership. $3800 for the truck and he said to me verbally that he'll give me a 30 day 1000 mile warranty. i had him do all the dmv and insurance transfers for a $40 fee the day before i picked up the truck. so i payed for it and got my bill of sale. the next day i pick up the truck and he asks to see the bill of sale. well i find out just now that the sneaky bastard wrote on the bill of sale that its "over 100k miles truck is as is". he wrote that on the bill of sale AFTER i signed it. i didnt make a copy or anything but you can totally tell its in a different pen and different handwriting. the problem is now that my A/C is not working and im not sure if hes going to fix it. im bringing it in tomorrow to try to get it fixed. anyone have any recommendations or suggestions on how to handle this? im bugging out. my father saw the bill of sale today and said that that note was definitely not on there.

When did you buy this truck? Was it more than 72 hours ago? Let me know ASAP because the time frame is important. Many states have a 3 day return policy on auto purchases (kind of like a buyer's remorse law). What state are you in? How did you pay from the truck (credit/cash)? Who was the dealer (is it connected to a mainstream dealership)?

I have some advice for you, but I need to know more info ...

ok i gave the bank check to the dealer on thursday and picked the truck up on friday. i was filing all the paper work like 2 hours ago (saturday night 10pm) when i saw that "extra" note on the bill of sale. i dont want to return the truck though. it runs perfect and everything else on it is awesome for $3800. i hate that they scammed me but i dont think i can find something better for this price. i just want them to fix the damn A/C. grrrr im not sure what to do!

i bought it with a bank check.
im in new york (long island)
the dealer is RP auto sales(just 2 crooks with an auto lot)

If you want to return the truck or not, he does not need to know that. Use the Buyer's Remorse Law as your bargaining tool. I use to be one of the managers at a very large car dealership and know that you have alot more rights than what you think.

Take the truck back. Tell him what he promised you as far as the warrenty. Don't mention what he wrote on there unless he brings it up. If he refuses to fix the truck tell him that he can have it back. He should change his tune. If not show him that you're serious. Leave the keys with him and walk out leaving the truck. Call you bank ASAP and see about canceling the check and tell them the situation. You'll get the truck fixed in the long run, but make him believe that you are serious. If you have to go all the way with this, he call you looking to sell it back to you. The longer he keeps it, the more money it costs him.

TAKE A WITNESS WITH YOU!! AND TAKE THE TAGS OFF THE TRUCK IF YOU HAVE TO LEAVE IT!!

Dan_90SR5 has made the points I was going to make with regards to using the Buyer's Remorse Law as a bargaining tool. Take your dad with you to the dealership, tell them there was probably an honest mistake, and calmly let them know what needs to be done to fix it.

If they're are completely unreasonable, tell them you will want to return the truck and see how they react. They will probably begin to work with you if they see you are serious. If they say "no", I would take off the tags (be sure to clear out all of your personal belongings), leave the truck, and tell them you will be contacting your bank and an attorney. Walk off the lot and call your bank. (If the dealership guys throw a ˟˟˟˟-fit because you are leaving your truck on their lot, tell them you are trying to return it--which is your right--and urge them to call the police if they are not happy about it). See what your bank has to say. Tell them you are being scammed. With any luck, they will help you out. Worst case, pay an attorney $150 to send them a threatening letter (this works really well). Be sure to contact the Better Business Bureau, too. I think you will find some relief given these (and Dan_90SR5's) suggestions.

One caveat, there is a good chance that even with the warranty, the A/C wasn't covered. A lot of those 1 month/1000 miles or 3 months/3000 miles warranties are for the drive train only (i.e., the transmission, etc.). If this is the case, they wouldn't be required to cover the A/C anyway.

Good luck, I know that an A/C on a truck like that can get expensive (I had an '89 Toyota Pickup that had the same problem ... $$!!).

the 72 hours do not apply to weekends when the business is closed. About 20 years ago, I helped a friend of mine return a car that was basically a lemon.
Also, each state's attorney general will pounce on someone that uses 2 different pens to alter a sales contract. Take a witness, park it first thing Monday at the dealer and you'll be surprised how fast he cooperates if you mention words like "BBB" , "attorney general", ""TV investigative reporter",

Before you leave it on the lot though, place a nice big dukey in one of the air conditioning vents, so that when they DO fix the A/C for themselves, they'll learn never to mess ...

use this golden oprotunity to turn the a/c pump into an on board air system. Just my .02 cents.
