Unhappy ?98 failed 15mph not 25mph smog, CA

Does anyone know if the dyno smog law says that the vehicle is supposed to be in 2nd gear during both the 15mph and the 25mph testing? Here's the problem. It passes if in 1st gear for 15mph and 2nd for 25mph. Unfortunately I have to take it to the test only station where they guy said "it is the law to test in 2nd gear". Is this true???

So what moron drives their car for long periods of time at 1481 rpm?

NO reading for 15 miles per hour (1481 rpm) 866 FAIL
NO reading for 25 miles per hour (2391 rpm) 167 Pass

I was told if cat was bad that they would both fail. I have no engine lite on, so sensors should be ok and the year doesn't have adjustable timing. Everything is clean and well maintained under the hood.

funny thing. my '88 1st gen passed better than avg. on everything.
