22R California Smog Fail

Failed smog yesterday, so please help me verify that my tech was a noob or that I am *gasp* wrong:
He failed me because of "tampering" - a vacuum line that was not hooked up. As far as I can see from the diagram, and if memory serves, I don't need the port to connect to anything because I don't have AC. Now let's see if the pics work. This is on the passenger side of the carb.

BTW, I'm talking about the gold-colored port in the background, not the port coming out from the air cleaner. Other posters have confirmed that that does not need to go anywhere, and the tech said he could "let that one go" but not the other one.
I just want to make sure I'm not missing something before I go to the "referee station"....good ol' California.

Damn...I'm glad I don't live in California. Here in MA, anything pre-98 is safety only and 98-up passes as long as the check engine light isn't on.

I bet 80% or more of the cars on the road would fail.

I agree with admiral, I gave up and left CA so I could keep my truck. That state is so screwed up with their smog referees and smog laws. So glad I don't live there anymore. My heart goes out to you bud, and I wish you the best of luck.

Good news

The tech sheepishly called me back and said he talked to one of his "buddies" (aka, his boss) and said in not so many words, that I was right. Had to go and get it all re-smogged, but they didn't charge me the "certificate" fee, so I saved $9. All's well that ends well, I guess.
In other news, the State of California sent me a letter this year offering me $800 for my truck - you know, just to get these old vehicles off the road, etc. "Not on your life!"
Is it weird that I've taken care of this little truck to the point that I take it personally when someone maligns it?.....her?
