Transfer case!!

Hey everybody, I got a 1995 toyota pickup bone stock with 145,000 on it freshly rebuilt motor, that is sticking in 4wd high when going back to 2wd and it is now rolling in 1st gear and reverse. No E-brake so I'm using a block of wood, any info on whether it is the Transfer, Diff or Tranny would be helpful or any suggestions!

Couple of things:
First, fix the e-brake as soon as you can. Besides being a safety feature, using it regularly is required to keep the rear brakes properly adjusted. Applying the foot brakes while backing up does NOT adjust the rear brakes on these trucks.

Your problem description is a bit confusing. I assume this is a manual, correct? Does the truck roll in 1st and reverse while the engine is off? If so, something is stuck in neutral and I can't see how it would go anywhere with the engine running, assuming a manual transmission. Are you sure you're not leaving the xfer case in neutral (position halfway between 4Hi and 4Lo)? Also, how have you verified it is stuck in 4wd high?

If you're sure you are operating all the controls correctly, the problem could be that the xfer case lever has popped out of the proper notches in the shift forks. It's pretty easy to take the top shifter plate off and inspect what's going on. You'll have to start by removing the center console. But before you do that, verify the xfer case shift lever moves freely from 2hi (left and forward), back to 4hi, right still in 4hi, forward to neutral, and then full forward to 4lo. Should click into the detents in each position smoothly and easily.

It is 5 speed, The problem only occurs while parked while the motor is off. The trans case lever is in an L pattern as 2hi down to 4 hi over to neutral and up to 4 Lo it gets stuck in 4hi and doesn't move freely to 2 hi, will shift while rocking (1st gear forward then back to reverse) and with force from me. it does operate in 2 hi once the trans shifter is placed into 2 hi. For the E brake the back brakes are in pieces and only has front discs for now… want to do mechanicals first to make sure its worth putting money in brakes into it. It's not as if the truck rolls away, but seems to grip the gear and then release it and then grab it again almost as if it isn't catching when I let off the clutch initial with the motor off.

I think I'd pull the shifters off the top of the t-case and have a look inside. Something doesn't sound right. Try moving the rails by hand once you get the top off.
