3vze longblock from S&J engines- valve problems

I purchased a longblock 3vze from a remanufacturer in Feb '10. It just turned over 14,000 miles. In late Nov. '10 it began to have cold start issues and idled rough. After chasing down other possibilities, which turned out to be ok, I did a compression test and found 60 psi in cyl 1 and 5. Yesterday the shop went in for a valve adjust and found both intake and exhaust valves with no clearance and they are hanging open.

Now remanufacturer says that its not uncommon to have exh. valves recede into the seats, but they claim the intake valves receding are a result of "something else" wrong with the engine, for example bad egr, or timing. In other words it was running too lean. I had no cel until after it had been idling rough for a month or so. BTW from 1200 rpm on up, engine runs perfectly and no real loss of power...lol 3.slow. Code 25 came up, several techs said that an open exhaust valve would throw that code.

Question: has anyone else had this issue, where the valves have sunk after only 13000 miles? Engine reman, will warranty heads, they claim they use toyota hard seats and valves, but they are trying to blame the intakes on lean running. Engine was scanned by the shop who installed the longblock and it checked out fine. (this was required by the reman for warranty) I know that a lean run will take out valves, but without a cel, i assume everything is within spec. What do they want a monthly scan for lean running

anyway its a long story and question, but if anyone has input, let me know. My tech has 27yrs with toyota and says theyre full of it. Hes pullin both heads and we will have them inspected by a qualified machine shop.
