waiver of liability form question

i recently aquired a bit of financial trouble that happened from playing baseball.. we were at a small park and a ball i hit hit someones dog pretty hard and put a split on the dogs head. the owner was pissed and i offered to pay the vet bill for the stitches.
the baseball game was my idea, and i feel moraly responsible.. so im willing to pay. but i want to make sure im covering my ass legaly and not paying now.. then paying in court.
he was very irrate and gave me a bad feeling. some people would just be sad there dog got hit.. and be happy if i offered to pay the bill.. but this guy was on the offense the whole time and talking legal mumbo jumbo..
it was his stupid dog that went after our baseball.. but i cant blame the dog..

i have an apointment to pay him tomorrow (this happened today). can i have him sign anything obsolving me of any further responsibility. i think if we go to court im gonna win, it was a public park, and he was bending the rules by being on something like a 60 foot leash. but any recomendations on wording i can use in the paper id like him to sign when i pay? or sites with templates?

Yes, definetly get him to sign something, and if he doesn't I would not pay.....
I would probaly just get a receipt from office depot and write in the notes section paid in full for vet bill and all related expenses due to incident. In a way, you paying anything is an admission of guilt if he tries to sue for more. This way your consceince will be relieved as well as all liabilty. I am not an attorney and this is not meant to be taken as any legal advice (just to cover my ass )

write him a check...that way there will be a paper trail...if you give him cash you'll be screwed if he does decide to goto court.

If you pay for it and there is proof then I think you'll be ok. I mean to a judge its gonna look just how it looks to us. You accidentally hit a dog with a baseball in a public park, you felt morrally responsible so you paid for the vet bill for the damages.

That should pretty much cover your butt.

But if the dog were to die now from complications there is no telling what could happen. He might have a case.

the idea of him suing from something accidental like that is pretty idiotic.

idiotic yes...unlikely no...everyone is sue happy so you really have to watch your butt.

I think we can all agree that alot of people consider a dog a member of the family. So if you and your kid, brother, sister whatever were walking through the park and they got smacked in the head with a baseball and there head was all torn up, you'd be pretty upset. So looking at it from the victims point of view this is kinda serious to him...

Hopefully this person ends up being a decent person and sees that you really care. I mean it was an accident and you did pay for the damages. But I would still be careful.

Was it a small ballpark? Or like a park with slides and stuff?

Where I'm from, if the dog is suffering then we just take them out of their misery. Crude I know but paying a vet for an animal other than livestock is not our way of living.

your crazy, haha my parents have paid thousands on vet bills....

if a dog needs stitches they hardly put them down....

Sounds like the latter.

If this is so, why does this fall into the "sue happy" category? When someone goes to a regular park, they don't assume the responsibility for getting hit in the head with anything. It's not a golf course.

If the guy’s dog dies, buying him a new one, even if worth thousands for that breed, is not that unreasonable.
