Unhappy Am I in trouble?

Sorry this is going to be a long post but here goes.... I went to pick up my gf's neice who is 3 yrs old, from her aunt who is babysitting her while I am in school and my gf is at work. Well my gf's cousin, the babysitter's 10 yr old son is about 250 lbs. and has a nasty temper. When I first arrived there he was getting a little rough with his cat, no big deal I didnt think nothing of it. Then him and my gf's neice start a small pillow fight. No big deal. Then they start a little shadow boxing and he nudges her every here and there, no big deal, but then he all of a sudden looked like he punches her in the stomach and she is flung over backwards. I yell at the boy and say the next time he does that then he would have to deal with me. His mom is sitting in a chair next to me and says not to talk to her son like that and that I would have to leave. No big deal, I just grabbed the girl and went out the door, got her carseat and got into my 4Runner. The aunt comes up to me and says that they were only playing and I said well that was a little bit rough for play. Then she goes off on a tangent about how my gf and her family are all crazy and stupid stuff like that. I just drive off calmly, even though it was muddy I didnt even spin out in her driveway or anything. Now legally would I be in trouble for talking to the boy like that? I never said anything other than that to him and quoted word for word. She didnt say anything about having me locked up or anything, but her family is known for doing low stuff like that. Please help! I am feeling nausous just thinking about it over and over.

dude that is fubar. sorry it happened. i'm no lawyer but speaking that way to someone who clearly is aggressive shouldn't be construed by any jury as abusive. do yourself a huge favor: document everything (more than you did, here). if anything, the boy should be guilty of assault and, since he's a minor, then the parents get custody and a slap on the wrist if you want to push it. however at this point it's all conjecture. if you feel truly concerned that the aunt will press charges, you should find a lawyer who specializes in family violence and get ready for a fight.

I seriously doubt you could possibly get in trouble...but you never know, I don't have a lot of faith in our "justice" system. Like photoleif said, document everything. Write down in explicit detail EXACTLY what you remember.

On another note, who the crap lets a 10 year old get to 250 lbs??! THEY should be in jail. And if he hits a 3 year old, maybe he should get what's coming to him.

I wouldn't worry too much about it. You were merely reacting in a protective manner towards the younger child. From the sounds of it you made no physically aggressive motions toward the boy, nor did you refuse to leave when asked.

I remember many moons ago when I was 'volunteered' to take a step-cousin (who was notorious for poor behavior) to the store with me. While exiting the store and crossing the parking lot, an older lady in a light blue full size sedan stopped to allow us to pass. As we passed the front of the car, this little punk, for no reason whatso ever, slapped the hood of her car, and yelled "I'm walkin here...!"

With out so much as a first thought (let alone a second thought) I reached back and gave him a SOLID open palm WHOLLOP on the back of his head! (in full view of the lady). I grabbed his earlobe (classic granny style) and held him in place till she parked. I then proceeded to drag him by said earlobe over to the lady and just looked at him (with death in my eyes I'm sure). He appologized to her with out me saying a word.

He never pulled anything like that again around me....

I don't think you are in any trouble for speaking that way. You perceived the situation becoming worse and responded appropriately. What would the alternative be? Allowing the kid to escalate things some more?

What's the deal with a ten year old who weighs 250 anyway???

You defense is you were protecting a child you were taking care of. Although you would have probably been better off just saying "Dont do that." I dont think you have much to worry about. If it was just her and you there you can say "I simple told the child not to play so rough and she asked me to leave. She followed me out and insulted me but I kept my calm and left." It will be your word agaist hers, only reason I say that is because I dont have any faith in our justice system and wouldnt want to take any chances. Remember, if the story you told us is accurate, you didnt do anything wrong....dont let anyone convince you otherwise....

Thanks guys, I feel so much better. I waited until my gf got off work and told her what happened and she was furious, but she isn't going talk to her aunt about it. We are just simply going to ignore them altogehter. I just felt bad talking to a 10 yr old like that but my rage was taking over instead of my brain and when I realized what I had said and she started in on me I just kept my mouth shut and took the girl home with my parents and waited to pick up my gf. I do realize I could've just warned him and told him to be careful but like I said I wasnt thinking at the time. It's kind of weird though... this isn't my child and I just stood up for her? My mom works for lawyers and she said it doesnt look like I would get into any trouble since I did leave and did not persue any actions against the boy. You should see his mother, she weighs my guess is over 300 lbs. and draws a check for herself and her 2 kids. Oh well I am just glad it's over with and I called an old babysitter who used to watch me years ago and she said she could watch her. As always thanks guys and the yotatech family.

I'm with the rest of these guys - you won't get in trouble, legally, at all. If anyone would get in trouble, it'd be that boy for punching her in the stomach like that. There was a case awhile back about some kid who did that to his little sister and she died ... the kid said "we were just wrestling like we always do, then her neck just broke!"

Anyway, you did the right thing, by all accounts.

Ever see a kid get smacked around in a grocery store or something similar to that. Can be a touchy situation and something that no one can ever know for sure what they would do but I personally believe that sometimes you just got to step in.

A less of an outburst warning would have been better but it is almost always best to err on the side of caution.

I think you did the right thing in trying to discipline the brat, something that his parent(s)/guardian(s) seem not to have any concept over.

I think she was just mad that you spoke to her kid that way and she didn't and bla bla bla...

Oh, Maybe that is what DYFS is for. So the kids can turn the parents in for trying to make them a decent human.

Yeah the kid is a brat, he will punch and cuss his mother out and she will just sit on the chair calling his name a million times and still not do anything about it. If I ever even back talked my parents I got a choice between a leather belt or a switch. I learned real quickly how to dance with a leather belt and to not get the skinny switches. Now I respect my parents and can see why they punished me. I do not remember a punishment that didnt end without my parents telling me they still loved me no matter what I did wrong and for that I admire them for. I just wished this world would do the same as my parents did for me whether spanking, grounding, or any other type of reasonable discipline.

Update

Some people's pet peeves are when people never update on anything on this board so I've got one for mine. This is a fairly small town so word gets around fast; my gf's Aunt has landed herself in trouble he he. Her son, the one I made my point to, was recently involved in a school fight with one of the kids and the kid never fought back. The little boy was beat up pretty good so when the Principal called his mom. The boy's mom was hopping mad and she wanted to press charges or whatever against the Bully. Well my gf's aunt is so mad that she is going to lose her son or whatever so she goes off the deep end and starts cussing and fussing the principal and the other mother out. The principal calls the police and they arrest her for something and the bully has been suspended and maybe going to the juvenile detention center. Ain't karma good

Wow, thats one messed up family. If I ever got into a fight in school, my own parents would probably disown me. Well, its good to see that kid will be getting some discipline now and hopefully his mom too.
