OK, I have a 96 limited with auto tranny and push button 4x4. It looks like there is a leak from the top of the transfer case, maybe the oil seal where the shifter lever goes in.
My questions are: can I use a gasket maker instead of buying a new seal and does the transfer share the same oil fluid with the tranny, meaning is there a seperate fill spot for the tranny.
Any help would be greatly appreciated cause im way outta town and don't wanna risk burning out my transfer on the way home.

Yes you can use gasket maker. On my '99, there is a metal wafer on top of the paper gasket. Save that, and use RTV (lightly) when re-installing shifter base.

Your transfer case uses gear oil. Your transmission uses ATF. Never the 'tween shall meet!

I just fixed an issue similar to this on my mine. In my case, it wasn't the gasket on the metal wafer, it was the actual shifter seat bushing. When I pulled it apart it was almost completely disintegrated. I would recommend replacing that at the same time since it's all apart anyway (and you will probably find that's the cause of the leak as well). Not easy to track down, but thank god for searching the forums on here. Marlin Crawler sells one for the 2nd gen that also fits the 3rd gen. I popped that in and it cured my leak. Toss the paper gaskets and use a thin layer of RTV.

I noticed that my transfer case was almost coated with gear lube and traced the leak to the top as well. I couldn't find any photos of the remedy described above so maybe someone will find them helpful. The metal wafer was sandwiched between two paper gaskets that had been compromised needless to say. I also noted that a breather tube had come off . . . or was left off when I had to have a new tranny installed last year. BTW, 99 4runner.

Thanks guys. I used some rtv to replace the deteriorated gasket and it hasn't leaked since!
