Uh oh, I think this might be your former 4runner. I believe you sold it, but if it matters, check out this auction:

The auction states that they are 2000 wheels but those 3 spokes are 98 wheels.

Yeah, that's old Dread for sure. Bastards! I guess I should send some e-mail or something. I wouldn't mind if it said "Like those shown below" or something like that.

I emailed him too and here was his reply:

Hahaha! My thoughts exactly. 12 year olds shouldn't be allowed to drive. I wonder whose tires and wheels he's actually trying to sell.

You know I think you guys are being a little rough. The guy needed a picture of the wheels and tires he is selling and Dread happened to have exactly what he was looking for.

I sell a lot of stuff on ebay, and sometimes I can see where taking someone elses picture is a good idea. I always, however, say that this isn't the actual item but one that looks like it.

I say no harm done, and I think Dread agrees.

It is theft, plain and simple. Copyrights make the person who took that image the owner of it, you legally cannot use it for any reason without their permission. There has been the issue with people using images like this to rip people off, and it could turn ugly for the person the image was stolen from if it gets back to him through a license plate number for example or other distinguishing mark like Gene's PIAA stickers on the doors.


But, it seems the guy had a good attitude about it. We've had others in the past that flat out denied our claims about the images that had been stolen and modified to cover up key things like watermarks. They were selling cheap knockoff imitation versions of a product and could possibly harm the legitimate business' reputation.

I agree with you 100% and I think that this is something that has to be looked at on a case-by-case basis. This guy isn't running a store and selling 20 sets of these tires and wheels, he is selling one set and needed a picture to represent them.

Where I work we use pictures all the time of one product, and a description of another. Maybe Sony or Panasonic doesnt have a picture to send us, but we want to stick it in the next ad. What else can we do but use a stock picture and change the description. It's better than no picture at all.

Saying that Gene could somehow become liable because there is a chance that this guy is a scam, and an even smaller chance that someone would run into the same picture on Gene's website is crazy. How on earth could Gene be held liable just because it is his picture? Or because it is a picture of his truck. Does that also make BF Goodrich liable because it is a picture of their tire?

If you're a retailer for a brand they supply you with rights to marketing media for the products you're selling, totally different. But they still cannot steal an image that an individual took of that item that the personally own. Usually the scams are fly-by-night shops or individuals with "hot" items or nothing at all but the hope that someone is stupid enough to send them cash. The chances of someone getting ripped off finding you is much better than you think. I just did a Google search for "toyota 4runner 265/75/16" and look what came up 5 down, a link to the page with the image in it on Gene's website...

To me, it doesn't matter if he's an occassional seller or a business seller. The example you gave is valid but only for *new* items and not used items.

It's completely dishonest to represent or imply that what you're selling is your own esp if the pic you use is not your own. The right way to do it is to get the permission from the site/pic owner and explicitly state something like "this is a pic of someone else's tires but mine are identical to these tires". Obviously the seller tried to make his item more attractive by using Gene's pic. Otherwise, he would've stuck w/ the stock images from the site.
